By accessing this website or submitting an enquiry, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept them, please do not use this website or engage our services.
Our services are available only to individuals aged 18 years and above who have the legal capacity to enter into a binding agreement under Malaysian law. By using this website, you confirm that you meet this requirement.

Cahaya Pencen provides legal advisory services in the area of pension and EPF-related matters within Malaysia. Our principal services are:

- —Pension Appeal Hearings Representation — direct representation at pension appeal proceedings before relevant authorities.
- —Pension Trust & Beneficiary Structuring — legal structuring of beneficiary arrangements and related trust documentation.
The scope, deliverables, and timeline for each engagement will be set out in a separate service engagement letter issued prior to commencement of work. Services are delivered in Malaysia and are subject to Malaysian law.

Payment terms: A deposit may be required upon engagement. The balance is payable upon completion of the service or at intervals agreed in your engagement letter. Accepted payment methods will be communicated at the time of engagement.
Refunds: Where an engagement is cancelled before substantive work has commenced, fees paid may be refunded at our discretion, less any reasonable administrative costs already incurred. No refund is available once substantive legal work has been performed.
All fees are inclusive of any applicable tax unless otherwise stated.

09 — Confidentiality
We treat all information you share with us in connection with your matter as strictly confidential. We will not disclose your personal circumstances to third parties except as required to progress your matter (for example, submitting documentation to a pension authority) or as required by law.
This confidentiality obligation survives the conclusion of our engagement and applies to all members of our team who have handled your matter.
10 — Termination
By you: You may withdraw from an engagement at any time by written notice. Fees for work already completed are non-refundable. We will provide you with copies of documents prepared on your behalf upon settlement of any outstanding fees.
By us: We may cease to act for you if a conflict of interest arises, if you provide materially false information, if you fail to comply with reasonable instructions, or if continuing the engagement would require us to act contrary to our professional obligations. Reasonable notice will be provided where circumstances allow.
Provisions relating to confidentiality, intellectual property, liability, and governing law survive the termination of any engagement.
11 — Governing Law & Dispute Resolution
These Terms are governed by and shall be construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Before initiating formal proceedings, we encourage you to raise any concern with us directly at [email protected]. We will make reasonable efforts to address your concern informally within 14 days.
12 — General Provisions
Entire Agreement
These Terms, together with any service engagement letter, constitute the entire agreement between you and Cahaya Pencen and supersede all prior communications.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
Waiver
Our failure to enforce any right under these Terms shall not be treated as a waiver of that right.
Assignment
You may not assign your rights or obligations under these Terms without our prior written consent.

We may update these Terms from time to time. Revised Terms will be published on this page with an updated effective date. For material changes, we will post a notice on our website homepage. Your continued use of this website or our services following publication of changes constitutes your acceptance of the revised Terms.
